Embryome Sciences, Inc. Product Safety

Embryome Sciences’ products may contain human or other animal source material; treat as potentially infectious.  Always use proper handling techniques. 

Products should be handled and used only by people trained in proper laboratory safety procedures at Bio-safety level 2 or higher as recommended by the CDC for any human or other animal sourced material. 

Product Use

Customer agrees not to sell or distribute any media, cell, cell sub-culture or cellular fraction to any other party. Embryome Sciences, Inc.'s products are intended primarily for laboratory research purposes and, unless otherwise stated on product labels, in Embryome Sciences, Inc.'s catalog or in other literature furnished to Customer, are not to be used for any other purposes, including but not limited to, in vitro diagnostic purposes, human or veterinary clinical purposes, in foods, drugs, medical devices or cosmetics for humans or animals or for commercial purposes. Customer acknowledges that the products have not been tested by Embryome Sciences, Inc. for safety and efficacy in food, drug, medical device, cosmetic, commercial or any other use, unless otherwise stated in Embryome Sciences, Inc.'s literature furnished to Customer. Customer expressly represents and warrants to Embryome Sciences, Inc. that Customer will properly test, use, manufacture and market any products purchased from Embryome Sciences, Inc. and/or materials produced with products purchased from Embryome Sciences, Inc. in accordance with the practices of a reasonable person who is an expert in the field and in strict compliance with all applicable laws and regulations, now and hereinafter enacted. Customer further warrants to Embryome Sciences, Inc. that any material produced with products from Embryome Sciences, Inc. shall not be adulterated or misbranded within the meaning of the Federal Food, Drug and Cosmetic Act and shall not be materials which may not, under Sections 404, 505, or 512 of the Act, be introduced into interstate commerce.

Customer realizes that, since Embryome Sciences' products are, unless otherwise stated, intended primarily for research purposes, they may not be on the Toxic Substances Control Act (TSCA) inventory. Customer assumes responsibility to assure that the products purchased from Embryome Sciences, Inc. are approved for use under TSCA, if applicable.

Customer has the responsibility to verify the hazards and to conduct any further research necessary to learn the hazards involved in using products purchased from Embryome Sciences. Customer also has the duty to warn Customer's customers and any auxiliary personnel (such as freight handlers, etc.) of any risks involved in using or handling the products. Customer agrees to comply with instructions, if any, furnished by Embryome Sciences, Inc. relating to the use of the products, and not misuse the products in any manner. If the products purchased from Embryome Sciences are to be repackaged, relabeled or used as starting material or components of other products, Customer will verify Embryome Sciences' assay of the products. No products purchased from Embryome Sciences shall, unless otherwise stated, be considered to be foods, drugs, medical devices or cosmetics.

Product Warranty and Guarantee

Embryome Sciences, Inc. manufactures products using the highest quality raw materials and incorporates ISO style quality assurance in every production run. Embryome Sciences warrants that its products will comply with its quality standards as stated in its product literature and/or on its website when the products are handled and used according to Embryome Sciences’ instructions.  Embryome Sciences makes no other warranty, express or implied, to the products ability to perform or fitness for use in research-related procedures. 

Embryome Sciences stands behind its products.  If Embryome Sciences’ products do not meet its written specifications, in accordance with Embryome Sciences’ warranty, compensation to the customer shall be either:  replacement of the product at no charge; issuance of a credit for the value of the product; or a refund of the customer’s money.  Compensation shall not be available if the Embryome Sciences product: has been used past its expiration date; has been damaged in shipment; has been improperly stored or handled; has been modified in ways not specified in product instructions or has been used contrary to label or instructions provided by Embryome Sciences.  In the case of media, growth factors or supplements, this product warranty is not valid if the customer has notified Embryome Sciences of defective product twenty (20) business days past the product expiration date.  In the case of living cell products, this product warranty is not valid if the customer has notified Embryome Sciences of defective product one year following shipment of the product to the customer.  When possible, Embryome Sciences reserves the right to test the product to confirm non-compliance with its standards before agreeing to compensation to the customer.   Embryome Sciences shall not be liable for any other compensation direct or indirect caused by our products including but not limited to lost profits.
